An Empirical Study On The Crime Of Drunken Dangerous Driving

Tragic cases of drunk driving occasionally crop up in front of the public,reminding people not to drive after drinking.Since drunk driving was sentenced in 2011,the guidance on the crime of drunk dangerous driving and the minutes of local meeting on drunk driving have been released.The number of dangerous driving cases has not decreased with the introduction of various laws and regulations,but has become the first in the number of criminal cases.Drunk driving into the punishment effectively curb the drunk driving accidents,provide powerful guarantee for public safety,but the increasing of the number of cases of judicial resources caused too much occupied,and this kind of case in use a lot of problems,cause bad influence to the judicial credibility.Therefore,the article studies to drunken type for dangerous driving sin in the applicable problem as a starting point,analysis the reasons behind the increase in the number of its and the cause of the problem,in order to to solve problems.The article main body is divided into four parts.The first part,with China’s network public written judgment of shaanxi xi’an 2019 dangerous driving crime judgment for sample analysis To reveal the current situation of the application of the crime of drunken dangerous driving;In the second part,through the collation and analysis of the data,it is found that the current drunk dangerous driving crime has such problems as low incriminating standards,disordered factors and inconsistent standards.The third part,through the analysis and research,and points out that the drunk type of dangerous driving sin is prescribed by law is not clear,discretion to use too much,etc.The fourth part,from the case itself and the reasons behind the multidimensional,based on the research of the xi’an drunk type for dangerous driving case,puts forward the drunken type of dangerous driving sin is applicable for the problems existing in the path.I hope this article research,to effectively control the incidence of drunk driving behavior,shall be applicable to the type of drunk crime of dangerous driving the problems are resolved,safeguard social public safety,protecting the legal rights and interests of citizens.
