On The Perfection Of China’s Foreign-related Adoption System

Based on the protection of the rights and interests of the weak,this paper studies the current foreign-related adoption system in China,mainly analyzes the deficiencies and problems of the existing system in China,and proposes corresponding solutions in order to further improve the foreign-related adoption system in China.Full text,except the introduction and the knot language as a whole is divided into three parts,the first part is specific to the system of our country concerning foreign affairs to adopt to protection of the rights and interests of the weak,through the definition of "the weak",elaborates the concept and characteristics,and make people more intuitive understanding of the to the sociology and law concept,the weak and the protection of the rights and interests of the weak in foreign-related adoption of theoretical considerations were analyzed,and the "weak" this concept and system of our country concerning foreign affairs to adopt combination of opening will post conception frames in under the protection of the rights and interests of the weak concept of foreign-related adoption system research,This paper will pave the way for the following research on the problems and improvement measures of protecting the rights and interests of the weak in foreign-related adoptions in China.In this paper,the second part,mainly is the adoptive relationship concerning foreign in each of the main problems existed in the protection of the rights and interests of the weak and exploration,mainly aimed at our country existing foreign-related adoption system including adoption before examination arrangements,the relevant provisions of the adoption of procedures rules and regulations,the related system adopted after our country concerning foreign affairs to adopt what specific problems.The third part of this paper,in view of the second part of China’s current foreign-relatedadoption before,during,after the three parts put forward the existing problems and deficiencies,specific countermeasures and specific Suggestions to solve the problem.Censorship,the author further perfecting the concerning foreign affairs to adopt advance and improve the system of regulation concerning foreign affairs to adopt things,such as the solution to an existing program trival,try to introduce a period system,set up compulsory notarization,finally improve foreign-related adoption afterwards supervision system,clear the establishment of the adoptive relationship to withdraw,build perfect tracking mechanism,and perfect the concerning foreign affairs to adopt bilateral cooperation mechanisms.Based on the protection of the rights and interests of the weak as the starting point,in view of the existing deficiency in foreign-related adoption system carries on the analysis,comparison and reference to domestic and foreign relevant reasonable case law and practice,to explore the regulation of our country concerning foreign affairs to adopt the improvement direction of system can learn and reference,to establish a complete close and fully protect the rights and interests of the weak adopted children foreign-related adoption system model.
