Research On The Connection Between The Handling Of Duty Violation And Duty Crime Under The Supervision Law

After the reform of the supervision system,the integrity of the direct and two-way connection mechanism of execution between the law enforcement agencies exercising administrative power and the public security organs,procuratorial organs and judicial organs has been broken."inspect" to the supervisory organ for illegal and his duties crime,investigation and treatment of the supervision of the integration of power.Therefore,the new cohesive mechanism of handling job-related illegal and job-related crime cases is separated from the traditional cohesive mechanism of execution,and the former mode of split two-element system in this field has been transformed into the current mode of integrated one-element system.The reform has brought about great changes.The former execution linkage mechanism is divided into two parts,one is the linkage between administrative violation and criminal offense,the other is the linkage between duty violation and duty offense.This paper focuses on the connection of the latter part,that is,from the perspective of coordination and connection of duty violation and duty crime cases.which is slightly different from the connection between supervision and judicial power.The first part of this paper mainly expounds the latest definition,connection and distinction of duty violation and duty crime from the perspective of supervision law.The second part starts from the vertical perspective of traditional execution connection to supervision connection,and then elaborates from the horizontal perspective of public security and market supervision organs’ jurisdiction cases connection to supervision connection,so as to introduce the supervision connection system and summarize the current three paths of supervision connection.The third part discusses the problems existing in the legislative and practical level after the operation of the supervisory cohesive model for a period of time.The fourth part puts forward suggestions from the five aspects of legal basis,legislation,evidence,investigation measures and supervision mechanism to improve the current supervision connection system,so as to help clarify the structure of state power Construction is conducive to the optimal allocation of administrative power,supervisory power and judicial power.
