| The film and television industry has developed rapidly in recent years.The key to its rapid development is to attract funds.Film and television companies are mostly asset-light companies,with less fixed assets such as production equipment and workshops.It is more difficult to apply for financing with intangible assets such as copyright.Therefore,in practice,a copyright pledge financing model has been gradually explored in order to solve the difficulties in financing film and television creation.The financing model for copyright in audiovisual works originates from the United States.At present,the practice in Japan and South Korea is relatively mature.China is still in the stage of development and exploration.Although basic related systems and practices already exist,they need to be further improved.In theory,China’s research results on the intellectual property pledge system are relatively abundant,but due to the nonsynchronization of cultural and financial markets in the field of audiovisual works,and the complexity of the subjects involved,the financing of copyright pledge financing of audiovisual works failed to match the patents.The rights and trademark rights have developed simultaneously and rapidly,and the theoretical research on the pledge of copyright in audiovisual works is still slightly lacking,which is difficult to guide practice.Therefore,systematic research on copyright pledge of audiovisual works has important theoretical and practical significance.This article takes the pledge financing of audiovisual works as the research object.The first part defines the related concepts of copyright pledge of audiovisual works,and compares the financing methods of other cultural industries,and draws the advantages of pledge financing of audiovisual works copyright.In the second part,the domestic and foreign developments of copyright pledge financing of audiovisual works are sorted out,and the current pledge financing models are compared.The third part focuses on the reasons why the film and television industry has great potential,but it is difficult for audiovisual works to obtain investment and financing.The conflict of copyright ownership due to the characteristics of audiovisual works copyright itself,the censorship caused by the external environment,and the prevalence of Internet piracy are obstacles to the realization of pledge financing of audiovisual works.The fourth part puts forward suggestions to solve the plight of financing the copyright pledge of audiovisual works in our country,and believes that a unified copyright registration system and a film guarantee system should be established;a mature value evaluation system should be cultivated to create a good environment for copyright pledge financing of audiovisual works to promote the prosperity and development of the domestic film and television industry. |
