| Financial consumers are the cornerstone of the financial market,which is significant for the healthy development of the financial industry.In the theory of financial supervision,cultivating the confidence of financial consumers and stable operation of financial institutions are two major goals of modern financial supervision.In the past few years,there has been a lot of research and Discussion on the concept and legal system of "financial consumers".In practice,China’s financial regulatory agencies have also established internal departments specially responsible for consumers in different industries,and have carried out some practical exploration step by step.However,in our intuitive sense,the protection of financial consumers has not been effectively strengthened,but often spread out vicious events such as "naked loan",usury,P2 P thunder and so on.At the same time,in the new era,the requirements of the party and the state for financial services to the real economy are becoming more and more specific and urgent.To a certain extent,it shows that there are still major defects in the design of financial consumer system,so it is particularly important to understand financial consumers,clarify the definition of financial consumers,and build relevant systems of financial consumer protection.This paper is divided into five parts to study the financial consumer system.The first part,as an introduction,describes the background and significance of the study,the main issues of this study and the research methods used in this paper.The second part explains the basic legal system of China’s financial consumers,and studies the provisions of China’s legal norms on financial consumers from the most broad concept of financial consumers,as well as the operation status of China’s financial consumer system.The third part,based on the study of foreign law,analyzes the legislative background and typical systems of financial consumers in the United Kingdom,the United States and Chinese Hong Kong,and points out that China should make systematic legislative improvement of financial consumer system in combination with the actual development of financial market.The fourth part focuses on the analysis of the different manifestations and main problems of financial consumers in banking,insurance,securities and cross finance.The most generalized financial consumers are divided into two categories: financial contract counterpart and financial investor,and the corresponding legislative principles are put forward.The fifth part puts forward suggestions on how to improve the financial consumer system.It describes from three aspects: establishing the concept of financial consumer legislative protection,improving the financial consumer protection management system and improving the system guarantee of financial consumer protection,and expounds that the goal of "financial consumer protection" should be extracted from other goals of financial supervision,through legislation to clarify the responsibilities of the financial management department,and establish a coordinated mechanism to solve the new problems in the financial market.At the same time,it also puts forward some detailed suggestions on the improvement of the assessment and evaluation system,consumer education system and compensation system. |
