| Globally,family trusts are widely used by wealthy families.With the development of China’s economy,a large number of high net worth groups have been produced,and family trusts have gradually entered their horizons.At the same time,the main assets of wealth group are corporate equity,so equity family trust has irreplaceable special significance compared with other types of family trust.Compared with the sound legal system of equity family trust in European and American countries and offshore areas,the system of equity family trust in China has not been fully established.In 2001,in order to meet the development needs of the times,our country issued the Trust Law,as the first law in the field of trust,which was born a business trust.The vigorous development in our country provides the basic guarantee.However,there are some defects in the application of trust law in practice,such as there is no legal regulation for civil trust such as equity family trust,which can affect the development of equity family trust.Based on this,the first step is to study the research results at home and abroad,to sort out,to lock in the current theoretical and practical areas of common concern;the second step is to examine the relevant legislation of China’s equity family trust,combined with the development of practice,summed up our country’s equity family trust’s equity family trust;the third step is to deeply analyze the current equity family trust system,and explore the deep problems in it.That is,from the perspective of equity family trust to analyze the basic trust law and the unique law of equity trust system is missing or vague,to find out the supporting regulatory system in the theoretical and practical level of deficiencies;the fourth step to solve the problem.Make full use of the international vision,consider the local reality,and put forward a systematic solution to the basic trust legal system,the special legal system of equity family trust,and the supporting supervision measures. |
