Research On The Connection Between The Lien Measure And The Criminal Coercive Measure

The most crucial part of the reform of national supervision system in 2019 is the lien measure in the investigation measures of the “Supervision Law”,from which it can be seen that the word “lien” has been familiar to everyone and even become an important node in the fight against corruption.In 2018,the state newly promulgated the “Supervision Law”,where the lien measure is especially eye-catching in the design of lien system.Moreover,in the “Criminal Procedure Law” newly revised in 2018,the issue concerning the connection between the lien measure and the criminal coercive measure is also involved.On the one hand,the specific content of the connection between the lien measure and the criminal coercive measure is still not detailed enough in terms of the system.On the other hand,the perfect connection between the lien measure and the criminal coercive measure is still an issue to be discussed in the actual operating process.This paper discusses the connection between the lien measure and the criminal coercive measure starting from their specific connotations.This article is divided into four parts.Firstly,this paper starts with the terms of lien measure and criminal coercive measure to discuss their connotations and natures and then distinguishes the differences between them.Secondly,it discusses the essence,value and legal basis of the connection between the lien measure and the criminal coercive measure.Then it expounds the content of the connection between the lien measure and the criminal coercive measure in detail,from which it elicits the most critical part,that is,a series of problems arising from the connection between the lien measure and the criminal coercive measure.Finally,based on the above problems,the paper gives corresponding effective suggestions to make it executable regarding the connection between the lien measure and the criminal coercive measure,which is more conducive to the connection from the perspective of practical operation and thus it can better promote the connection between the lien measure and the criminal coercive measure from various aspects.
