Research On The Establishment Of Community Correction Institutions In China

As a representative of modern non-custodial penalty enforcement system,community correction system has obvious effects on saving national penalty resources and promoting community correction objects to return to society.And behind all of these results,are inseparable from the institution to set up the basic link of this system design.However,with the reform and development of China’s penal system and the deepening of the community correction,the current community correction system of functional position and implement the requirements set by the specific links such as defects emerging in practice,if the status,the existing institutions will gradually difficult to meet the development needs of modern non-confinement penalty execution system.In view of this,the author of this paper tries to make a further in-depth discussion on the establishment of community correction institutions in China from the perspective of penalty execution,so as to contribute to their development and perfection.The first part of this paper is the nature orientation of community correction institutions in China.Part as the basis of research institutions,the first to return to the connotation of community correction system,illuminates the community correction mechanism of penalty,and then from the nature of the judicial administrative organs of the development in combination with the practice,to clarify the unity and independence of community correction mechanism,and based on the characteristics of deep understanding of its nature gradually spread below theory discussed in this paper.The second part is the necessity of perfecting the establishment of community correction institutions in China.This part from promoting national rule of law,the pursuit of national penal justice and speed up the national penal civilization three dimensions,reveals the significance of the implementation of community correction system in China,expounds the concrete reason of perfecting our country’s community correction institutions set up,and also for the perfection of the community correction institutions set up to guide the direction.The third part is the analysis of the current situation of the establishment of community correction institutions in China.This part by combining the development status of China’s community correction system and institutional setting the objective reality,from the management institutions and the partition of actuator and to coordinate and guide organizations and specialized work of the division of two dimensions into concrete study the current set of community correction system defects in our country,and analyses the cause of the problem discussed in this paper.The fourth part of the article is the author of the establishment of community correction institutions outside the region.This part respectively from the development of community correction system is more complete or more of the United States,Japan and Taiwan region system of community correction mechanism,this paper further analyzes the reasonable of institutions in the design of the system,and summarize the experience of its development is complete process,try to explore on how to perfect the community correction in China institutions of inspiration.The fifth part of this paper is the specific path to improve the establishment of community correction institutions in China.This part was handled in the institutions of community correction in China’s current defects and their causes are analyzed on the basis of combining the successful experience of development of community correction institutions outside the region,specific talk about community correction institutions in our country should be how to improve the ideas and Suggestions,in order to set up and improve the benefit of our country’s community correction institutions,thus further promote our country the implementation of the construction of the rule of law and penal civilization process.
