The construction of the legal system of the right to be forgotten under the network environment is a major research topic in legal studies with the in-depth development of the Internet and meeting people’ s yearn for a better life in the new era.The construction of the legal system of the right to be forgotten under the network environment is becoming a hotspot of research at home and abroad and yet is a relatively lagging field of legal studies in the practice of law-making.By using the method of interaction between legal t.heory creation and institutional innovation,this paper insists on the research methods of combination of theory with practice,correspondence between historical experience and realistic demand,mutual consideration between institutional innovation and system improvement,complementation of overall investigation and case analysis,and attempts to find a system integration interface of legal governance,which gives prominence to Chinese legal system while also drawing on other legal systems.The paper applies methods of institutional innovation,system construction,interpretation improvement and model transplantation,etc.,to make generalized deconstruction and reconstruction of the construction of the Legal System of the law of right to be forgotten under the network environment,with the aim to provide a balance of interests in information resources sharing for the rapid development of the Internet,and hence to provide a theoretical framework to cognize the construction of legal system of the right to be forgotten.The study finds that the construction of legal system of the right to be forgotten under the network environment has both the legal basis and the support of advanced extraterritorial experience.The Chinese version of legal system of the right to be forgotten is relatively lagging behind,however,in the context of the in-depth development of China’ s network sovereignty security and information technology,as long as the integration of institutional innovation and non-compulsory institutional arrangements is strengthened,the legislation and judicature of the right to be forgotten can adapt to the development needs of the times.The legal suggestions are to strengthen the legal system based on the national conditions,absorb extraterritorial experience and practice actively,reinforce with the means of legislative construction and judicial improvement,etc.,and promote the construction of the Chinese version of legal system of the right to be forgotten.
