Problems And Countermeasures Of Judicial Openness Under Artificial Intelligence Vision

Artificial intelligence as a new force has been flooded in all aspects of social life,at the same time artificial intelligence has brought a new impact on the judicial openness.The emergence of a series of new technologies,such as artificial intelligence,makes the form and way of judicial information dissemination have a new meaning.Standing on this new era node,how the judicial system responds to the public’s informed request for case information,how to protect the case party’s informed request for case information and so on,all face new circumstances and challenges.In the new era of socialism with Chinese characteristics,intelligent judicial openness faces new problems,and judicial openness cause the challenges to personal privacy,the dilemma of the operation of the judicial openness,the obvious unreasonable scope of the judicial openness,the severe formalization of the judicial openness,and the increasing conflict between the judicial openness and the new media all affect the realization of the social function of the judicial openness and the normal development of the daily judicial work.The relationship between judicial openness and traditional judicial openness in the era of artificial intelligence is innovation and development,and the relationship between intelligence and judicial openness is becoming more and more complex.The first and second parts of this paper discuss the reasons for this topic,and discuss the theory and practice of this topic at home and abroad,and look forward to the research prospect and research value.The third part explores the theoretical basis of "artificial intelligence" and "algorithm ",and the fourth part studies some outstanding problems in the process of judicial openness of artificial intelligence and analyzes the causes of the problems.The fifth part is to strengthen the path of privacy protection,introduce the way of third-party supervision,strengthen the ability of judicial supervision,break through the barriers between judicial data to realize judicial openness,train compound talents for the implementationof judicial openness,standardize the regulation of new media on the administration of justice,arrange the game between judicial function and social supervision function reasonably.The author believes that artificial intelligence,as a tool to assist judicial openness,can certainly help judicial openness,and finally realize judicial fairness and justice.
