The Risk Management Of Internet Judicial Auction With House As Target

The Supreme People’s Court of The PRC proposed that the reform of judicial auction should be intensified,with the focus on the implementation of Internet judicial auction.In recent years,China’s Internet judicial auction has developed rapidly,with the number of auction participants,auctions and transactions increasing year by year.Of all the Internet judicial auctions,auction with houses as target has the largest amount,attracts the most bidders’ attention.And houses as target have the dual attributes of both social and economic,particularity.This thesis focuses on the research on the risk management of Internet judicial auction with houses as target.There are also some risks in the process of Internet judicial auctions with houses as target.Due to the house is auctioned and delivered with current situation,there are some risks such as property rights unknown,taxes unknown,occupied by other people.If the early investigation of Internet judicial house is not clear,it will cause transaction subjects additional losses or increase costs.Strengthening the risk management of Internet judicial auction with house as the target plays an important role in restricting the government’s power rent-seeking,enhancing the credibility of government departments,improving judicial efficiency,establishing judicial authority,reducing buyers’ costs and increasing public participation.This thesis is divided into three parts.In the first part,I firstly summarized the Internet judicial auction system with houses as target in China.Secondly,I analyzed the system,the implementation and the risk analysis of current situation of the Internet judicial auction system with houses as target in China respectively,found out the problems in it.In the second part,through researching the American current situation of risk management measures of judicial auction with house as target,especially the law system,broker system,real estate registration system,title insurance system,I summarized what can draw lessons for our country’s Internet judicial auction system with houses as target from it.In the third part,I proposed to strengthen the risk management of our country’s Internet judicial auction system with houses as target,including enhance the speed of legislation,the management of assist agency,the system of information disclosure and especially,introduce the title insurance system to our country.
