Research On The Dilemma And Countermeasures Of Lawyers’ Participation In People’s Mediation

With the progress of society,people’s material life is constantly enriched,ideological and ideological progress,complex,professional social contradictions are constantly emerging.It is not good for the construction of harmonious society to settle only through litigation.As a means of resolving social contradictions with a long history,non-litigation mediation plays an important role in various ways of resolving disputes in China.Among them,people’s mediation is an important part of non-lawsuit mediation.People’s mediation has its unique advantages in the non-litigation mediation system,including no charge,one-time handling of contradictions,reducing the occurrence of secondary contradictions and so on.However,in combination with the current social reality,people’s mediation is still in accordance with the traditional way of mediation,only by the people’s mediation to deal with social contradictions and disputes is often difficult to play a good social effect.In order to cope with this complex situation,it is particularly important for lawyers to participate in the people’s mediation.As a special group with a legal specialty,lawyers have an understanding of relevant legal knowledge and judicial practice experience,and have a congenital advantage in participating in resolving complex social contradictions.Based on this,the participation of lawyers in people’s mediation will greatly improve the good social effect of people’s mediation system in dealing with social contradictions.However,in the process of lawyers’ participation in people’s mediation,they face many difficulties.How to solve this dilemma and better play the role of lawyers in people’s mediation has become an urgent problem to be solved in people’s mediation system.This paper quotes the successful case of lawyers participating in the people’s mediation,which reflects the necessity of lawyers participating in the people and the social effect after the participation.This paper analyzes the dilemma of lawyers participating in people’s mediation and tries to explore the countermeasures to solve the dilemma of lawyers participating in people’s mediation by means of investigation and research.Finally,the author hopes to solve the difficulties faced by lawyers participating in people’s mediation and to better guarantee the development of people’s mediation towards the direction of institutionalization,rule of law and system.
