Qualitative Research On The Behavior Of Doctors Receiving "Red Envelopes" In Criminal Law

Giving red envelopes has been one of the traditional customs of the Chinese nation since ancient times.We bestow on red envelopes the feelings of blessing on relatives and friends,affection for junior members,and gratitude for others,the red envelope custom is one of the important bridges that the contact person and the human contact,get along.But with the continuous development of the economy and the abundance of material life,the red envelope has gradually been given a "new meaning"by some people,and has become a "hidden means" to bribe or ask for money.At the same time,because of its secrecy,often make the law to start,also can not accurately distinguish the true connotation of "red envelope".Now in the medical field,there are frequent such problems,and"red envelope" is a wide variety of categories,there are various names of "consultation fees","labor fees" and so on.Because of the prevalence of "red envelopes",many people see it as a matter of course,and the doctor’ s"red envelopes" with patients or their families are extremely secretive and difficult to be found,this kind of behavior not only affects the incorruptibility of the medical field,but also affects the image of"the angel in White" in treating patients and saving them,and often increases the economic burden of many patients and their families.At the same time,any problems in the treatment under the "red envelope" behavior will become a fuse,directly causing disputes between doctors and patients,and even lead to the public questioning of the entire medical system.On such issues,although the national health sector put forward the corresponding rectification measures,but the effectiveness of the rectification is not satisfactory.Today,the frequent occurrence of violent medical injuries,the disorder in the medical system,and the loss of public ’trust in the medical profession should make the public alert behind each case,the"red envelope" problem is now in the medical staff and patients between a huge gap,must be resolved.Therefore,facing the serious problem of doctor-patient relationship,we should analyze the problem in time and find out the problem point,according to the contradiction point,promulgate the corresponding law and policy,improve the People’ s legal consciousness,and check the unhealthy trend,so we can better ease the conflict between the doctor and the patient.This article mainly through five parts of specific research,in-depth analysis of doctors receiving "red envelopes" behavior of the Criminal Law Qualitative:First of all,to clarify the doctors receiving "red envelopes”behavior qualitative research purposes and significance,through the form of Social Survey Questionnaire,to get a deeper understanding of how this kind of behavior works in the minds of the general public.Only with a true and in-depth understanding of the public’ s perception of the behavior can we accurately identify and resolve the contradictions one by one.Secondly,the phenomenon of "red envelope"is summarized,the harmfulness of this kind of behavior is defined,and the ways to deal with this kind of behavior at home and abroad are studied.After that,the paper expounds the three main controversial viewpoints,analyzes and summarizes them one by one,and puts forward his own views.Fourth,some focus issues on the behavior of doctors receiving "red envelopes" are re-analyzed to clarify the nature of the doctor as the main body,and finally define the specific nature of the behavior.Finally,combining with the research results of scholars at home and abroad,this paper puts forward corresponding concrete legal suggestions for such problems,with a view to adding strength to the targeted crackdown on some doctors receiving "red envelopes",purifying the medical system,and easing the doctor-patient relationship,to maintain the long-term stability of society.
