Study On The Administrative Enforcement Procedure Of Illegal Construction

Over the years,under the rapid expansion of China’s economy,the cities and towns make progress,has been accelerating,and violations of urban construction regulations have emerged,and many problems are not uncommon.This has caused the government to invest more energy to deal with violations.The issues is related to illegally reconstruct have also become the focus of focus of attention in theory and application.At the moment,proficient and scholars both inside and outside,the industry regard it as a key research topic.From a professional and practical level,they have systematically analyzed and discussed the problem of illegal construction,and have explored more valuable research results.However,it can be seen that the results of studying the enforcement of illegal construction from the combination of theory and practice are few.Consequently,in the context of stream-lined the line national governance horizontal coverage,how to inquire into and manage construction that break the rule by the government’s administrative law enforcement agencies is a tremendous test of the administrative skills,he administrative law enforcement institution.Therefore,it is of tremendous theoretical and practical significance,a study that how to investigate and deal with illegal construction from the viewpoint of administrative law.At present,there are still the following problems in the study of illegal construction in the theoretical and practical circles of administrative law:the enforcement of illegal construction enforcement procedures by administrative law enforcement agencies;the investigate and treat and action against of the diversification of illegal construction subjects;and the duty for Forcibly eliminating of illegal facilities,Rights relief,etc.We need to conduct more in-depth theoretical research on the practical problems raised by the above-mentioned investigation and handling of illegal construction practices.Based on the theoretical puzzles and practical problems of the above-mentioned forced demolition illegal construction,this article is divided into four parts for research.The first part is the basic theory of illegal construction,analyzes the definition of illegal construction and the types of illegal construction from the theoretical level;the second part is to study the legal attributes of illegal construction enforcement,and analyze and study the nature of illegal construction enforcement;The third part is mainly to study the actual law enforcement process of the compulsory demolition of illegal construction In the fourth part,based on the balance of property protection,administrative efficiency and public interest,the author tries to put forward to strengthen the theoretical research,reconstruct the execution procedure of illegal construction,and punish the illegal construction crime,so as to optimize them The exercise of administrative public power,to achieve the goal of streamlining and efficient illegal construction and governance,and to create a good social atmosphere of prevention and control of violations.
