An International Comparative Study Of The Judicial Committee System

Judicial Committee System is a unique structure of judicial system in our country.There is no previous mode for reference.Thus,all the system construction and working system for courts at all levels form gradually and develop during working practice.They are very essential and difficult to improve and revise accordingly based on the ground of judicial reform like how to make clear the position of judicial committee,how to select the member of judicial committee,how to deepen the function of judicial committee,how to solve the principle conflicts between access to justice and how to balance the conflicts between collegiate bench and judicial power.Chief Justice Conference System of Romano-Germanic civil law tradition and Supreme Court Grand Chamber System of Anglo-American common tradition,it has some common points with China’s Judicial Committee System,and has certain reference significance in solving complicated cases and the linkage of higher and lower courts.The Judicial Committee System in China has a long history and is reasonable under the current judicial system.Since the judicial reform in 2016,the Judicial Committee System has faced increasingly prominent problems in functions,positioning,theories and other aspects,which also have adverse effects on judicial justice,judicial independence and judicial efficiency.And we can offer some improving advice on improving the legal system of judicial committee system,making clear of the selection system of judicial committee system,optimizing the working mode and reforming the functions of judicial committee system to make sure the positive function of our judicial committee system with the background of our own country situation and judicial reform.
