Research On Legal Issues Of Membership Identification Of Rural Collective Economic Organization

China’s rural population is huge,and rural harmony is related to the orderly development of the entire society.The rural collective economic organization is the main form of self-management of the rural collective economy,and its stable operation depends on the implementation of related rights and interests of internal members,clarifying the legal standards for the identification of membership of rural collective economic organizations can provide the most basic guarantee for the rural population,effectively eliminate the worries of the vast number of peasants,and liberate the rural productive forces to the greatest extent.Although the relevant content of membership identification of rural collective economic organizations is involved in the existing legal provisions,there are few provisions on its related microstructure.The concept,identification standard,legal system and other contents of membership identification of rural collective economic organizations are only mentioned in a few legal provisions without any pertinency,this blank area has brought some troubles to the judicial practice,caused frequent disputes of related land rights and interests,infringed on the economic interests of peasants,and also hindered the process of the reform of China’s rural collective property rights system to a certain extent.Therefore,this paper will combine theory and practice,on the rural collective economic organization membership of the legal issues related to the specific anatomy,in order to fill this legal gap is beneficial.The first chapter of this paper analyzes the related concepts and legal characteristics of the membership of rural collective economic organizations.It clarifies the concepts of rural collective economic organization and members of rural collective economic organization,and obtains the definition of membership qualification of rural collective economic organization.The analysis of basic concepts lays a foundation for the following research.The second chapter points out the necessity of studying the legal issues about the membership of rural collective economic organizations.Starting from the case,this paper analyzes that there are some chaotic states in the identification of membership of rural collective economic organizations in practice:the standards for the recognition of membership in rural collective economic organizations have not been unified and the recognition system has not been improved.Therefore,it is necessary to study the legalissues related to the identification of membership of rural collective economic organizations: it is helpful to clarify the membership rights of rural collective economic organizations and protect the rights and interests of rural residents.The third chapter analyzes the status quo of membership recognition of rural collective economic organizations,including the status quo of accreditation standards and accreditation systems.This paper compares the relevant theories and theories on the determination of membership of rural collective economic organizations,and discusses the advantages and disadvantages of the standards that have been set.This paper analyzes the status quo of the legislation,judicature and procedure of the membership recognition of rural collective economic organizations,and obtains the improvement direction of the relevant legal system through comparison.The fourth chapter combines the setting principles of membership criteria for rural collective economic organizations,and comprehensively considers the advantages and disadvantages of various criteria,so as to obtain a relatively reasonable and feasible qualification criteria for membership of rural collective economic organizations,and bring the qualification criteria for special groups into the accreditation standard system.Fifth chapter through the above described the rural collective economic organizations membership identified the problems existing in the system,puts forward ideas and specific legislative subjects and legislative ways,the affirmation of the role of villagers’ self-governance and rural collective economic organizations membership that disputes actionable,perfect the current rural collective economic organizations membership program.
