Research On Evidence Collection And Preservation Of Drug Rehabilitation Law Enforcement In China

In recent years,drug production and drug trafficking have become increasingly rampant and the problem of poverty and death caused by drug use has become increasingly prominent.Drugs have become one of the major causes affecting social stability and the normal life of families.The state has invested a lot of manpower and material resources to strengthen the compulsory isolation of drug addicts while cracking down on all kinds of drug crimes.However,in today’s information society,media network,and the social public to the rehabilitation work,especially the negative events of drug work enough interest,a huge increase in addicts,such as critical care rehabilitation for medical disputes,addicts events such as sudden death,self-injury also increase gradually,not only seriously affect the drug law enforcement credibility,but also threaten the life safety of the civilian police.Current strengthen the drug law enforcement evidence collection and preservation work,no matter to avoid unnecessary disputes caused by compulsory isolation detoxification,to clarify the legal liability of drug law enforcement personnel,improve the credibility of drug law enforcement,or in accordance with the law to protect the legitimate rights and interests of addicts,and the legitimate rights and interests of drug law enforcement officers,all has very important significance in theory and social reality.With "drug law enforcement evidence collection and preservation studies" as a topic,based on the current drug law enforcement in the evidence collection and analysis of the problems existing in the management,this paper expounds the significance to strengthen the management of drug enforcement evidence collection and,and on how to further perfect the relevant drug enforcement evidence collection and management regulations,scientific grasp the forensics principle,strict review evidence,transformation law enforcement idea and so on has carried on the beneficial discussion.It is hoped that it will be helpful for the smooth implementation of the law enforcement work in China and the protection of the legal rights and interests of drug addicts and law enforcement personnel in accordance with the law.Besides the introduction,this paper mainly includes the following five parts:The first part,based on the method of empirical analysis,considers the collection and management of evidence in China’s current drug law enforcement.At present,there have been many problems in the law enforcement of the detoxification Institute in China,the degree of social concern is further improved,the awareness of the rights of the detoxification personnel has been increased,the problems involved in the detoxification are further increased;the law enforcement has become a general trend and the law enforcement behavior needs to be further transparent;the development of drug abstinence is facing bottlenecks and the concept of law enforcement needs to be further further studied Change.The second part mainly explains the basic theory of collection and management of evidence of drug enforcement.Firstly,the concept and main types of evidence collection for drug enforcement were explained.Secondly,it expounds the theoretical value and social significance of evidence collection and management.The third part mainly analyzes the main problems of evidence collection and management in China.Firstly,the collection and management of evidence is not standard,the evidence collection procedure is not reasonable and the content of evidence collection is not comprehensive.Second,evidence review and identification is not strict,evidence review is not comprehensive,evidence identification is not accurate.Thirdly,evidence archiving management is not scientific,evidence archiving custody responsibility is not clear,evidence custody process is not rigorous.The fourth part mainly analyzes the reasons of the existing problems in the evidence collection and management of drug enforcement in China.First,on the institutional level,the relevant legal system is imperfect and the use of evidence is too isolated.Second,at the level of drug enforcement,the consciousness of evidence preservation of law enforcement police is weak and lack relevant evidence knowledge.Thirdly,at the level of drug rehabilitation organs,lack of evidence collection equipment and loose management of evidence collection.The fifth part mainly discusses the conception of how to perfect the collection and management of the evidence of drug enforcement.First,set up special file,realize the rule of law of evidence work;Second,divide the level and classification,and show the systematization of evidence work;Thirdly,understand strategy,collect evidence and highlight the delicacy of evidence collection.Fourthly,the informatization of strict examination and represervation reflects the preservation of evidence;Fifth,improve quality,strong guarantee and show the specialization of evidence work;Sixth,observe procedures,pay attention to efficiency,and present the transparency of evidence work,so as to ensure the smooth implementation of drug enforcement.
