The Legal Risk Analysis Of Chinese Enterprises’ Investment In Mongolia

With the action plan on the China-proposed " Belt and Road " in-depth,Chinese companies are rapidly picking up investment activities in Mongolia.However,the Chinese enterprises’ investment road in Mongolia’s mineral resources is not smooth.Compared with booming mineral investment practices,there are still some problems and legal risks in the course of Mongolian mineral investment.This article try to clarify the development process of China’s mining investment in Mongolia,summed up the categories of the legal risks existing in Mongolia’s mineral investment,so as to analyze the causes of these legal risks.Therefore,this paper based on the successful experience of developed countries,puts forward the prevention of China’s enterprises on the Mongolia’s mineral investment of the legal risks.The article is divided into six parts.The first part is an introduction.This part mainly discusses the background of research,research purpose and significance of shareholder’s emptive right.To reveal the importance of China enterprises to Mongolia’s mineral investment.In the second part,the author mainly introduces the basic situation of Chinese enterprises’ mineral investment in Mongolia and the investment purpose.First of all,the author briefly introduce the history and current situation of China’s mineral investment in Mongolia.Then explain the purpose and value of China’s mineral investment in Mongolia from three aspects.In the third part,analyzes the bilateral laws of Chinese enterprises’ mineral investment in Mongolia.Clarify it from four aspects:tax,mineral exploitation and specialized laws.In the fourth part,the author focuses on the analysis of the legal risk types and causes of Chinese enterprises’ mineral investments in Mongolia.Firstly,the paper defines the concept of legal risk characteristics.Secondly,focuses on the analysis of Chinese enterprises’ mineral investment legal risk types in Mongolia.Finally,review the causes of these legal risks in detail.The fifth part is divided into two sections.The first section put forward the ways of prevention of these legal risks for the Chinese enterprises to mineral investment in Mongolia from the perspective of our government.Firstly,the Chinese governme should accelerate the development of the "foreign investment law".Secondly,the Chinese government should adequate incentive policy in Chinese enterprises’ mineral investment of Mongolia.Last but not least,should consummate the mineral investment insurance system.The second section from the angle of enterprises put forward proposals to prevent legal risks of mineral investment in Mongolia.Also including three points.First,Chinese enterprises should pay attention to their own legal risk prevention.Second,Chinese enterprises should furnished by the domestic and foreign insurance institutions to transfer the risk of mineral investment.Third,Chinese enterprises should diversified ways of mineral investment to scatter the legal risks.The sixth part is the conclusion part,which is used to refine the various discussions above.
