China is now experiencing dramatic economic and social transformation.Main players in Labor relations are diversifying,as well as their interest.In such a situation,the intensive conflict is inevitable.It is important to build a harmonious labor relation.The "retail leasing"model which may reduce the retail cost and complexity of management become popular in recent years.The model achieves a win-win scenario because Shopping malls are able to integrate the rent and management fee while manufacturers can make profit from customers visiting the shopping mall.However,the immature "retail leasing" mode in China has brought a series problems including unclear rights and responsibility distribution between employer and host,unequal labor right and responsibility between employee and employers,which lead to frequent labor infringement law suits.Taking the "retail leasing" practice in Fuzhou City as the example,this paper uses case study method to analyze the status quo and origin of labor infringement.By combining the experience from abroad and also domestic,e.g.trust rating and deposition before entrance,this paper draws suggestions to improve the protection of the right of labors.Public administration bureau,enterprises employee and labor union,i.e.the interest groups in "retail leasing",should build together a harmonious working relationship,make equal treatment employees,reduce labor dispute and improve employee’s well-being from their own perspective.
