A Report On E-C Translation Of A U.S. Supreme Court Judgment Of A Trademark Case

Trademark registration is one of the important issues in intellectual property cases.In recent years,some trademarks pending for registration have been rejected because they may have a negative impact on society.The translation of the text of judgments of foreign trademark cases will help Chinese readers understand the facts of trademark cases,and has great practical significance for the study of judgments of trademark cases.This report is based on the translation practice of a trademark case ruling by the U.S.Supreme Court.The name of the judgment is "Ianku,Deputy Minister of Commerce and Director of the Patent and Trademark Office of Intellectual Property v.Brunetti".The case was due to a controversial trademark.The U.S.Patent and Trademark Office refused to register the trademark on the grounds of an "immoral and scandalous" bar in the Lanham Act,but lost in the first instance.Later,the case was appealed to the Supreme Court of the United States.In June 2019,the U.S.Supreme Court issued a verdict upholding the original verdict.The translation practice report aims to use the functional equivalence theory as a guide to explore the problems in the translation process and propose targeted solutions.Before the translation,the translator studied the U.S.trademark law and read relevant cases through online search to accumulate background knowledge of translation;recorded the difficulties encountered during the translation process,and found a solution to these problems within the framework of functional equivalence theory.After the completed,the translation was improved through a variety of methods,and further amendments were made to the segments with translation problems.This report will use comparative analysis to explain the practical significance of functional equivalence theory in solving the problem of judgment translation.In translation practice,the translator found two types of problems at the vocabulary level and sentence level,and detailed the translation problems encountered,analyzed them in a targeted manner,and gave specific translation methods.While proposing specific translation strategies,the translator also pointed out the effect of the practical application of the functional equivalence theory behind it.Based on the above analysis,the translator concludes that the functional equivalence theory has practical significance in guiding the translation practice of legal judgments.With the guidance of the theory,the translator chooses appropriate translation methods to solve actual translation problems,which greatly improves the translation quality.
