| Kant’s Philosophy of Right is about the legitimacy of external freedom and the legitimacy of coercive force.Both his theory of Rights and moral theory embody the spirit of freedom.He deduced morality from the freedom of the rational being,and then the law of Right from morality.The theory of Right is the external application of freedom involved in moral theory.In the study of Kant’s theory of Right,this paper discusses the moral basis of Kant’s theory of right,that is,the relationship between the legislation of internal freedom and the legislation of external freedom.The three principles of Categorical imperative involved in moral theory can be proved to be the principle of division of the doctrine of Right.And the freedom and legitimacy of possession in the doctrine of Right are temporary and cannot be guaranteed in the state of nature,so must change from the natural state to the civil condition,in the civilized state the possession can be long-time guaranteed.In the state of civilization,Kant thinks that the state of nature between nations is an unjust state,a state that needs to be overcome,and then turn to the legitimate state of law and perpetual peace. |
