| With the deepening of China’s opening to the outside world,more and more Chinese enterprises join the teams of ‘going out’.The risks faced in export trade are complex and diverse.Especially in recent years,the domestic and international macro-environment of battery field has changed greatly in politics,economy,society,technology,environment and law,and the medium environment of the battery industry is also facing new challenges.These changes and challenges further increase the risk probabilities of export contracts for batteries.Analyzing on the environmental status and risk process of export trade contract risk formation in battery industry,and then taking effective preventive measures on the contract risk,has both theoretical value and great practical significance.This paper first defines the basic theory of contract and export trade contract,risk and risk management.Then the risk environment of export trade contract of storage battery industry is analyzed from macro,medium and micro perspectives by using environmental analysis method in risk identification.Firstly,the macro-environment of battery industry is analyzed from six dimensions of politics,economy,society,technology,environment and law by adopting the PESEL analysis.Secondly,the medium-environment of battery industry is explored from five aspects based on the Porter’s Five Forces Model: bargaining power of upstream suppliers,bargaining power of buyers,competition among industries,threat of new entrants and threat of substitutes.Combined with the questionnaire survey of relevant departments and employees of H company,the SWOT analysis and the H company’s real cases,the micro-environment and risk formation process and categories of battery export trade are deeply analyzed.The internal and external risk cases encountered in H company’s battery export trade contract include the contract clause selection risk,internal management risk,bank-related risk,government-related risk and transportation and insurance risk.According to the logical sequence of before contract signing,during contract execution,after contract execution and during contract filing,this paper systematically analyzes factors which will lead to the battery export contract risk.These factors can be roughly divided into two categories in qualitative analysis,namely,the risk caused by external factors and the risk caused by imperfect internal management of enterprises.In the early stage of contract signing and execution,the risks brought by internal and external factors coexist.However,during the quality guarantee period after the contract is executed and the filing period of the contract,the risk of the contract mainly comes from the inside of the enterprise.By analyzing the environmental background of H company’s battery export contract risk and the internal and external factors affecting the contract risk,with the help of SWOT analysis method,a SWOT model to prevent the risk of H company’s battery export contract is constructed.In order to prevent the risk of H company’s storage battery export contract,it is necessary to make full use of H company’s own advantages,improve its weaknesses,seize opportunities and eliminate risks.This paper points out that the improvement in the ability of risk prevention must be based on the strengthening of the awareness of enterprise external and internal prevention.In the aspect of external prevention,by means of perfecting laws and regulations,perfecting credit monitoring of foreign enterprises,letting the Trade Facilitation Process details easy to act,establishing information release platform,expanding communication scope,and helping to solve trade disputes,the government and trade associations work together to create a fair,safe and convenient export trade environment for enterprises and reduce external causes of export trade contract risks.The internal risk prevention and control can be realized by establishing customer credit management system and sharing the credit data;taking advantage of the advantages of external platforms,actively participating in the training of knowledge related to import and export trade;enhancing the ability of enterprises to perform contracts,strengthening the reserve of foreign trade talents,strengthening internal learning of various factors of export trade contract risk,and improving contract approval system and contract seal management.And with the help of the above measures,the contract risk can be prevented and transferred in advance. |
