Research On Legal Issues Of Disposal Of Waste Electrical And Electronic Products

The rapid development of productivity has brought opportunities for the development of electrical and electronic products,but the discarded electrical and electronic products may also cause serious or even irreparable damage to the ecological environment.At the same time,due to the resource nature of waste electrical and electronic products,if they are recycled and processed in a standardized way,the efficiency of resource utilization will be greatly improved,and their impact on the ecological environment can be effectively reduced.At present,although there are relevant laws and regulations on the disposal of waste electrical and electronic products in my country,the "Law on the Prevention and Control of Environmental Pollution by Solid Waste" revised in 2020 clearly stipulates the extended producer responsibility system for electrical and electronic products.However,through the analysis of the current legal status of the disposal of waste electrical and electronic products,the following problems still exist: the extension system of producer responsibility for electrical and electronic products is not perfect,the standardization of the recycling system is not strong,the supervision measures for the disposal process are not strict,The legal accountability mechanism is not perfect.Through an in-depth analysis of the legal systems in Japan,the European Union,Sweden,Germany and other countries and regions on the recycling and disposal of waste electrical and electronic products,four legal experiences are drawn: First,the relevant subjects such as producers,sellers,consumers,etc.Second,it has a complete recycling system legal norms,including establishing a recycling labeling system,setting clear recycling standards,and setting up a special producer responsibility organization;third,implementing strict supervision over the entire process of disposal;finally,setting Diversified processing fee burden models.Drawing on foreign experience,the following improvement paths are proposed for the above problems:First,improve the extended producer responsibility system of electrical and electronic products.The ecological design system should be implemented at the beginning of the production process of electrical and electronic products,the use of toxic and hazardous substances in electrical and electronic products should be restricted during the production process,and the relevant responsibilities of producers should be refined.Second,standardize the recycling system of waste electrical and electronic products.my country should improve the market access system for recyclers,raise the entry threshold,and establish a compulsory recycling system for waste electrical and electronic products,in addition to establishing a recycling deposit system.Third,strengthen supervision over the disposal of waste electrical and electronic products.The information disclosure of the disposers should be strengthened.At the same time,in order to achieve openness and transparency and facilitate subsequent traceability,a tracking record system for the entire disposal process should be established,and the completeness of the waste electrical and electronic product disposal fund system should be ensured.Finally,improve the legal accountability system.The subject of legal responsibility should be expanded,the legal responsibility of producers should be increased,and a "double penalty system" should be introduced in administrative penalties related to waste electrical and electronic products.
