ecological and environmental problems.More and more people begin to pay attention to environmental problems,and the focus has been focused on the production links that directly produce environmental problems.The environmental protection laws and regulations that have been promulgated and implemented are mostly aimed at the production links.In recent decades,although the environmental rule of law has made remarkable achievements,environmental problems have not been eradicated,and some areas of environmental problems are more serious.Fundamentally,the legal regulation of environmental protection in the field of production can reduce the unnecessary environmental pollution and resource consumption caused by the subjective reasons of producers,but the expanding consumption demand requires the production scale to expand,and the environmental problems limited by the objective technology and economic level still cannot be eradicated,especially people blindly expand consumption,compare consumption and luxury consumption Cost and even waste seriously affect the production process,stimulate the continuous expansion of production,and unnecessary environmental problems continue to occur.Constraining consumer behavior through legal regulations is not to prohibit,compress,or restrict consumption,but to guide and restrict human behavior,eliminate luxury consumption,comparison consumption,show off consumption,waste and other consumption behaviors,and advocate moderate and economical green consumption habits.Green consumption is used to guide mass energy production,reduce unnecessary production losses and pollution emissions,so as to fundamentally solve environmental problems and resource consumption problems.As a scientific,recyclable,and sustainable consumption concept,green consumption is an important manifestation of environmental protection in the field of economic consumption,affecting all aspects of social development,and promoting green product production,energy resource conservation,and ecological environment Protection and other fields play an important role,which can bring a more comfortable environment to people’s lives and make it possible to develop harmoniously between man and nature.Under the guidance of the concept of green development,green consumption activities and green consumption practice are in full swing in China.However,the legal system of green consumption has not yet been established,and the rules of green consumption are general and scattered,which can not form a systematic system for green consumption behavior.To a certain extent,it hinders the in-depth promotion and development of green consumption activities.In order to give full play to the restriction and guidance of legal system on green consumption behavior,based on the defects and deficiencies of green consumption legal system,this thesis discusses the perfection and optimization of China’s green consumption legal system,so as to restrict consumption behavior with perfect legal system and reasonably guide consumers’ green consumption,so as to make it reverse transmitted to production activities and reduce the risk of unnecessary consumption In order to reduce or even avoid the occurrence of environmental problems in absolute quantity and improve the ecological environment of China in an all-round way.The research mainly adopts the methods of literature induction,comparative analysis,and the combination of theory and practice to study the related issues of constructing China’s green consumption legal system.In addition to the introduction and conclusion,the article is divided into four parts.The first part explains the definition,connotation and theoretical characteristics of green consumption and other basic issues,collects and sorts out the literature of domestic and foreign experts and scholars,and understands the connotation and significance of green consumption from multiple angles;the second part mainly introduces green consumption The current situation in the world,and taking the three countries of the United States,Germany and Japan as examples,to study and compare their green consumption legislation,and conclude that China’s green consumption legal system can be used for reference;the third part is based on China’s green consumption system The status quo,analysis of the defects and shortcomings of China’s green consumption legal system;the fourth part proposes to build a green consumption legal system framework system in China,from the perspective of "promotion +prohibition",promulgated the "Green Consumption Promotion Law" and "Anti-Waste Law" 》,to realize the two-pronged legal constraint of promotion and prohibition;for the government,the largest consumer in the market,continuously improve the government’s green procurement system to effectively promote green consumption;improve the green tax system and guide consumer behavior through tax constraints;establish perfect green products The certification system provides a product carrier for the realization of green consumption;through the improvement of the consumer rights protection system,consumers are encouraged to make green consumption,thereby promoting the in-depth development of green consumption.
