Research On Legislation Of Classified Of Municipal Solid Waste In China

The continuous expansion of the scale of cities and the continuous growth of the population have caused the amount of domestic waste to be increased day by day,and the problem of waste classification has gradually become the focus of attention.In this context,the necessity of legislation as an important way to promote the classification of domestic waste is highlighted.In the past two decades,my country has built a legal system for garbage classification at multiple levels,but there are still many problems.For this reason,it is necessary to continuously improve this,construct a legal implementation guarantee system that truly meets the actual needs of my country’s urban domestic waste classification,and explore a sustainable development of urban domestic waste classification.Based on the above thoughts,this article is divided into five chapters to carry out in-depth research on the current legislation on the classification of urban domestic waste in my country.The first chapter is the introduction,including the research background and research significance,combing and summarizing the domestic and foreign research status of municipal solid waste classification legislation.The second chapter is an overview of the classification of urban domestic waste in my country,focusing on explaining the basic connotation and related theories of domestic waste and domestic waste classification,and summarizing the necessity of perfecting the legislation of municipal domestic waste classification: it is not only the need to promote the construction of ecological civilization in the new era,but also The need to promote the legalization of the waste classification system is also the need to promote waste reduction and realize resource regeneration.The third chapter analyzes the status quo of legislation on the classification of municipal solid waste,mainly combing the existing laws,administrative regulations,departmental regulations,local regulations and other normative documents,and dialectically analyze the breakthroughs and deficiencies of the legislation on this basis.In terms of legislative breakthroughs,my country has achieved the legalization of environmental ethics,strengthened the principle of reduction and reduction targets,and focused on problem-oriented solutions for domestic waste classification.In terms of lack of legislation,there are problems such as lack of legislation and scattered provisions,frequent changes in local classification standards,unreasonable division of legal responsibilities of various subjects,imperfect construction of internal and external supervision systems,and limited scope of incentive mechanisms.The fourth chapter clarifies the reasons for learning from Japan,introduces the background of the country’s various stages of garbage classification legislation,and further analyzes the representative basic laws,comprehensive laws,and special laws in the legal system of municipal solid waste classification in Japan,so as to summarize the successful experience of Japanese garbage classification.Finally,the fifth chapter proposes the basic ideas for establishing the legislation for the classification of urban domestic waste in my country,focusing on improving the legal system for waste classification,formulating reasonable standards for classification of domestic waste,clarifying the legal obligations of relevant subjects,improving the internal and external supervision system,and implementing the garbage classification reward and punishment system.Five aspects will improve the legislative framework for the classification of urban domestic waste in my country,and strive to solve the predicament of the "garbage siege" in our cities.
