Abstract/Summary:
This thesis analyzes the impact of theological belief upon the worldview and jurisprudence of Supreme Court Justices Harry Blackmun and William Rehnquist. In the process of this analysis, this thesis focuses on the role of the Reformation and the Enlightenment in shaping conservative and liberal Protestantism. The core of this thesis is the contention that the jurisprudence of Blackmun and Rehnquist drew heavily from the theological and intellectual worldviews that these two important movements imparted to Western civilization. Though Blackmun and Rehnquist served as the key legal figures under discussion, the use of worldview as a model for better understanding Supreme Court jurisprudence holds great promise for future legal research.
