The legal framework of the transition to a market economy in East European countries. The case of Romania

Abstract/Summary:
The transition from communism to a democratic society, that Eastern European countries have engaged in, is a very complex process, that embraces all aspects of social life. In this restructuring process, the task of converting the centrally planned economies into market-oriented ones becomes fundamental in all these countries. But the implementation of the market mechanism requires, as a sine qua non condition, the reform of the legal system. An examination of the recently formulated legislation and of the context of its application will provide the basis for this claim.;In my analysis, I shall discuss especially the problems associated with the changes in the legal context of the Romanian economic reform, keeping in mind, however, that all former communist countries are facing similar problems which stem from their historical experience and common legal background.
