Regulatory Dilemma Of Industrial Investment Fund

Industrial investment fund is a private equity investment fund,which is developed by the development of private equity investment fund in China,which serves the economic transformation of China and develops the demand of high-tech industry.In the early 1990 s,the industrial investment fund established by foreign institutions opened the exploration stage of China's industrial investment fund,and the main basis of the regulations was to establish the interim measures for the management of Chinese industrial investment funds.In 2001,the interim measures for the management of industrial investment funds by the national development and reform commission(the national development and reform commission)aim to regulate industrial investment funds,but at the time,the scale of equity investment was small,and the exploration of industrial investment funds had not continued,and the legislation was not available for the time being.The state council has proposed a pilot program to speed up industrial funds in the "ten-fifth" plan,and a group of industrial funds,including the Bohai industry investment fund,have set up a group of industrial funds,including the bohai industry investment fund.In 2007,the commission of the NDRC,the bank of China insurance and insurance regulatory commission,and other departments jointly discussed the regulations on the production of industrial investment funds for industrial investment funds,but also failed to be introduced.Contrary to the law,high-tech industry innovation,entrepreneurship and investment funds have been developing rapidly in the government's policy support for the next two decades.In the face of the tens of millions of private equity investment funds in the capital market,the lack of specific legal basis for industrial investment funds is a problem.This paper is divided into five chapters,the first chapter begins with the explanation of the equity investment fund,and expounds the definition and legal characteristics of the industrial investment fund.Chapter ii studies the basic law relations and organizational form of the industrial investment fund,and the third chapter combines the relevant laws and regulations of industrial investment and the government's industrial support policy,and analyzes the legal problems of the long-term development of the investment fund.Chapter 4 introduces the specific legal regulations and government support of the investment fund in the United States,South Korea and Israel,and the policy support of the development of the industrial investment fund,which has laid a solid foundation for the development of the enterprise capital and the development of the industrial investment fund,and has obtained the stable system environment of the United States,South Korea and Israel,and promoted the country's industrial economy to be developed.The law is less based on the law of industrial investment funds,and the development model of government policy will limit the construction of industrial investment funds in the domestic transformation and upgrading industry,and support the role of the real economy,not only cause the development of the market boundary to be bad for the management and supervision of the industrial investment fund,but also may cause the legal legitimacy of the industrial investment fund,and can prevent other qualified private capital from entering the industrial investment fund.In combination with the actual situation of capital development in China,the industrial investment fund of our country should introduce more detailed and specific law rules,standardize the development path of equity investment fund,and excavate the new momentum of economic growth,and develop innovative industrial investment fund in the new stage of 2020.The conclusion of this paper is the main conclusion of this paper,and the direct financing function of future industrial investment funds will be more useful for China's large infrastructure construction and innovative technology industry construction.In order to solve the development of industrial investment fund,we should pay attention to the lack of the law of the investment fund,and fill the legislative gap,whether it is to revise the current investment fund law,to make the industrial investment fund into the department door method,or to set up special laws and regulations for industrial investment funds,the institutional design must keep in keep with the development demand of the economy,and stimulate the development of the real economy.
