As an important measure to solve the difficult problem of financing in rural areas,the mortgage loan business of rural land management right has achieved good results through national trials,but the business has not yet formed a perfect and mature mechanism and system.Land concerns farmers 'livelihood security,their fundamental interests and their social stability,while the right to land management belongs to usufruct rights and has only partial disposal power,which has its particularity and limitations.This poses a potential risk for financial institutions to carry out the business.The financial institution is the executor of the business,but the financial institution is a for-profit enterprise that has to balance risk and benefits.But the land management right mortgage loan business has the high risk,if the financial institution bears the whole risk does not have its rationality.The government is the driver of the business,but it is not able to cover the full loan risk due to fiscal revenue and fiscal budget.Therefore,financial institutions and the government should share the risk of the business.From the point of view of the government,it is necessary to establish a risk compensation system.Each pilot is also trying to establish a sound risk compensation mechanism,but has not yet constructed a complete and effective compensation mechanism,so this is also the main issue to be studied in this paper.This paper first analyzes the macroscopical background of the research and the significance of the research,summarizes the relevant literature studies at home and abroad,clarifies the research objects and themes,combs the research contents and ideas,and selects the research methods.On this basis,using the theory of land "separation of powers",incomplete competition market theory,and external theory as guidance,we analyzed the financialization and financial attributes of rural land management rights.This paper studies the legal guarantee,policy support and successful practice exploration of its realization,and analyzes the particularity and weak mobility of rural land management rights.Secondly,the paper analyzes the rural land management right mortgage loan pilot situation and the existing problems,and uses the mathematical model to analyze and measure the influencing factors of the rural land management right mortgage loan business evaluation.Thirdly,this paper expounds the risks existing in the land management right mortgage loan business,analyzes the necessity of risk compensation,draws inspiration from the practice of risk compensation in each pilot government,and puts forward the establishment of risk compensation system from the perspective of the government.Finally,on the basis of the analysis of the previous period,the author puts forward the countermeasures and suggestions to improve the rural land management right mortgage business.First,we will improve the laws governing land management rights and mortgage loans.Including the improvement of the "Land Contract Law","Security Law" and "Property Law";Establishing a system of dispute mediation and arbitration;We will improve the supporting system for risk compensation mechanisms.Second,improve the land property rights mortgage related system and the construction of supporting facilities.Third,we need to strengthen financial and ecological development in rural areas.
