The freedom of the press,which is a fundamental right of citizens,is important to people’s life.With the development of internet technology and the emergence of digital publishing,publishing activities become more and more prosperous.In addition to express the role of politics,publishing activities have become a popular way to express art and emotion.Article 35 of the current constitution clearly provides guarantees of press freedom.The definition of press freedom includes broad sense and narrow sense.In the narrow sense,press freedom refers to the right of citizens to express,compile and produce publications by using words according to their own will.Both broad and narrow sense include the freedom of content from illegally interference.As a fundamental rights of citizens,press freedom needs to be fully guaranteed by the state.However,the right is not absolute,citizens enjoy press freedom with restrictions according to the law.The publishing industry has an ideological attribute and bears a certain social responsibility.At present,the restrictions of China on press freedom are mainly reflected in the restrictions of publishing activities and contents.Although the restrictions are constitutional in essence,it is not constitutional in form because it does not conform to the principle of legal reservation.In practice,it is also faced with the problems of the insufficient standardization of restrictions,the lack of effect of prior supervision and the urgent need for adequate measurement of benefits.Combined with the theory and practice of restricting the freedom of press worldwide,the restriction of press freedom can be improved from the following aspects.The first is to give full play to the restrictive role of the basic rights provisions of the constitution.Besides,we will improve the system of publishing laws and regulations,implement the principle of interest measurement and focus on the right characteristics of the freedom of the press. |
