On The Improvement Of My Country's Compulsory Traffic Insurance Compensation System

With the number of motor vehicles increasing year by year,the problem of victim relief caused by traffic accidents is becoming more and more prominent.But in the rescue system,the Motor Vehicle Third Party Liability Compulsory Insurance System(hereinafter referred to as compulsory traffic insurance)gradually causes our discussion and research.The system has been in operation in China for more than ten years.Whether from the point of view of legislative purpose or social effect,it is of the nature of protecting the interests of the third party and treating the wounded,the enhancement social security management and the universal insurance consciousness aspect has played the pivotal role.But at present,as the core content of compulsory traffic insurance legal system,the compensation system of compulsory traffic insurance still has many problems and deficiencies in legislation and concrete implementation.For example,the setting of individual compensation limits is not scientific,the implementation of uniform liability limits and compensation limits throughout the country is on the low side,the scope of compensation is not appropriate,the problem of non-liability compensation and the limits of vehicle insurance coverage are not strict,etc.,all these problems weaken the rescue function of compulsory traffic insurance in different degree.In the face of the limitation of the compensation system of compulsory traffic insurance,by means of the typical cases found in the trial practice,a comparative analysis is made and combined with the actual situation of our country,while learning from the advantages of foreign compulsory traffic insurance compensation system,we will continue to standardize the standards and scope of compensation,establish effective mechanisms,reasonably determine the limits of liability,thoroughly optimize the business model and supervision system,and better realize the intention of establishing the compensation system for compulsory traffic insurance,make the system serve the social construction with more tensility.
