Coordination Of Medical Behavior And Patients' Right Of Informed Consent

In recent years,the medical trouble continues,the awareness of rights should be affirmed,but the legality of the rights of the people doubt.There is a conflict between medical behavior and the exercise of the patient’s right to informed consent,such as the order in which the right of informed consent is challenged by the patient’s family,the form and condition of the exercise of the patient’s right to informed consent,the balance between medical behavior and the patient’s right to informed consent,and the scope of compensation for medical damage are the main issues studied in this paper.Starting from the typical case,analyze the case dispute,define the medical behavior,analyze the nature of the patient’s right to informed consent,the exercise subject and the order of the act.Combined with the standard of informed consent ability judgment and the various theories of the medical instruction suing obligation,the effective conditions for the exercise of the patient’s right to informed consent and the nature of the informed consent form are demonstrated.In this paper,the coordination of the conflicts of interest between doctors and patients should clarify the scope of the patient’s right to informed consent,exercise the subject,the standard of medical damages,the judgment criteria of emergency medical treatment,and establish a medical liability insurance system in line with the national conditions.
