Research On The Right To Be Forgotten In Russia

At present,the era of big data is sweeping the world,and the frequency of using all kinds of data on the Internet is unprecedented.The memory in the Internet is different from human memory.People can choose to forget,but machines can’t.Once personal information is published on the Internet,it will become an indelible record.Some outdated information has a great impact on people’s work and life.Therefore,individuals play a certain role in the timeliness of the information related to them in the global network information system and solve the problems quickly,which makes it necessary to establish the "right to be forgotten".The right of oblivion in Russian law is multidimensional and complementary.In the substantive law,there are the forgotten right in the civil code and the forgotten right in the information law.In the procedural law,there are the forgotten right in the sense of the civil procedure code.The three have a clear division of labor and cooperate with each other to jointly guarantee the realization of the forgotten right of citizens.However,this right has not been clearly defined in the current legislation of our country.Therefore,it is necessary to learn from the experience and lessons of Russia’s forgotten right legislation.For China,which is trying to introduce the right of being forgotten,the general provisions of the civil code on the right of being forgotten put forward by the Russian legislative model,the specific case types of protecting the right of being forgotten in the field of search system,the determination rules of the special jurisdiction for establishing the action of the right of being forgotten and the extraterritorial effect of the right of being forgotten are all indispensable for thinking about the legislation of the right of being forgotten.This paper analyzes the definition,connotation and judicial practice of the forgotten right in Russia,so as to summarize the beneficial enlightenment for China.Moreover,the study of the forgotten right system is related to the future trend of the information age.It has profound significance of the times andtheory to explore the rationalization of the system in our country.
