Research On My Country's Anti-monopoly Punitive Damages System

The punitive compensation system of anti-monopoly has great significance to the development and implementation of China's anti-monopoly law.As a civil liability system,the punitive compensation system has the functions of punishment and deterrence.Many countries have applied the punitive compensation system in the field of anti-monopoly law,such as the absolute three times damages system of the United States and the discretionary three times damages system of Taiwan The system not only protects the legitimate rights and interests of the victims,but also strikes and curbs the illegal monopoly.With the continuous development of China's economy,the number of monopolistic behavior is increasing gradually.However,there are still some omissions in the provisions of the anti-monopoly law on the compensation system for damages,which are not very practical,and the provisions of the legal liability system are too light.If we let it go,it will inevitably lead to the destruction of the market competition order.In order to regulate this phenomenon,China should introduce the anti-monopoly punitive compensation system.The addition of punitive compensation can not only make up for the deficiencies of the current anti-monopoly damage compensation system,but also prevent the occurrence of illegal monopoly behavior and promote the implementation of the anti-monopoly law.
