Research On The Awareness Of Ecological Environment Protection In Tibetan Customary Law

Tibetan nationality has a long history and splendid culture.For thousands of years,the Tibetans have written brilliant chapters and made immortal achievements in the process of exploiting the plateau,developing the extraordinary culture of the Chinese nation and jointly creating Chinese history.As an indivisible member of the Chinese nation,Tibetan,like other ethnic groups,has formed traditional habits of its own national characteristics that adapt to the natural environment of plateau in the long history of development.Many of its customary laws have incorporated the consciousness of ecological environment protection and made positive contributions to the protection of the ecological environment of the Qinghai-Tibet Plateau,which is worth our researching and studying.Since ancient times,the Tibetan people have worshiped the natural creatures in nature as gods,and they protected them for fear of nature.Coupled with the influence of later Buddhist doctrines,this belief and custom evolved into customary laws and a kind of cultural inheritance along with the development of history,which enabled the preservation of the pure land of the Qinghai-Tibet Plateau in good condition.The contents on the Tibetan customary law of ecological environment protection are highly evaluated in related domestic literature,according to which,we must attach great importance to and utilize the Tibetan customary law of environmental protection to maintain the ecological environment of the Tibetan area flexibly and effectively under the circumstance that national laws are not sound and practical implementation can’t be fully realized.However,the Tibetan customary law of ecological environment protection is not perfect.With the rapid development of economy and the continuous improvement of people’s living standard,the Tibetan customary law of ecological environment protection also shows its inadaptability to the concepts of ecological environment protection of the new era.According to many documents with regards to the domestic research,the contents of the Tibetan customary law of ecological environment protection mainly concentrate on the protection of ecological environment,while few people study on prevention and control strategies.In fact,the unique Tibetan customs have caused a certain degree of pollution to the ecological environment in the Tibetan area,such as excessive prayer flag hanging,excessive captive animal freeing,excessive incense burning,etc.,which have generated negative effects on the ecological environment of Tibet.If we don’t stop them,we will lose the last piece of pure land on the Earth one day.Tibetan customary laws are the product of the unification of Church and State.Due to the coercive power of the regime and the penetration ofBuddhist precepts,Tibetan customary laws have a high position and great impact in the Tibetan area.In addition,owing to its strong practical operability,low costs and other factors,they have exerted great influence on regulating the contradictions among people,protecting the ecological environment in the Tibetan area,maintaining regional stability and promoting the historical development in the Tibetan area.As a Tibetan,this is an issue worth further and thorough study.Without doubt,with the development of market-oriented economy and the improvement of people’s living standard,some Tibetan customary laws are inadaptable to the people’s growing demand for a better life,especially the Tibetan customary law of ecological environment protection.We should not only approve the positive contribution of the Tibetan customary law of ecological environment protection but also analyze its negative influences,such as global warming,the sharp decline in biodiversity,melting glaciers,etc.Especially,in the present when extreme weather occurs frequently,we should practice the environmental protection concept brought up by Chairman Xi Jinping,namely,“lucid waters and lush mountains are invaluable assets”,realize the significance and necessity of ecological environment protection,distinguish the two sides of the Tibetan customary law of ecological environment protection,promote a better development of the ecological environment in the Qinghai-Tibet Plateau and make due contributions to the community with a shared future for mankind.
