Research On The Legal Issues Concerning The Withdrawal Of Mining Rights Permits

With the overall enhancement of China's comprehensive national strength and the rapid development of social life,environmental problems are becoming more and more serious.Under the requirements of the current era,the state has promulgated and adjusted a series of policies related to ecological protection,and adjusted the disorderly development of natural resources.In July 2017,the Ministry of Land and Resources issued the Work Programme for Clearing up Mineral Rights in Nature Reserves,which requires that no new mining rights should be established within the scope of nature reserves,and that mining and exploration activities should be prohibited in nature reserves,and that mining rights in nature reserves must be withdrawn within a time limit.This measure undoubtedly has a serious impact on the mining rights holders,and may seriously damage the rights and interests of the legitimately established mining rights holders.Based on the actual situation of the withdrawal of mining rights license in China,this paper analyses and studies the main problems currently facing.The main contents of this paper are as follows: Chapter 1 analyses the definition of specific concepts of mining rights,the discrimination of related legal concepts of administrative withdrawal,the clarification of concepts of mining rights license withdrawal and the basic theory on which mining rights license withdrawal is based.Chapter 2 investigates the current situation of the withdrawal of mining rights license,mainly analyzing the background,system and practice of the withdrawal of mining rights license,and analyzing the current situation of the system from the national and local levels.Chapter three expounds the main problems existing in the withdrawal of mining rights license and analyses them.Chapter IV focuses on the analysis and exploration of the problems raised in the previous chapter,and puts forward reasonable and feasible solutions on this basis.When researching the legal issues of the withdrawal of mining rights license,we should fully guarantee the balance between public and private interests.We should not only solve various problems in the withdrawal process of mining rights license,but also focus onimproving the ways of compensation and right relief for mining rights holders,so as to safeguard the legitimate rights and interests of mining rights holders.
