Research On Commercial Bribery Under The Anti-Unfair Competition Law

The Anti-Unfair Competition Law was promulgated in 1993.Since its promulgation,it has made great contributions to maintaining market order and establishing a fair market environment.However,with the rapid development of economy,in today's market background,some clauses have obviously lagged behind the times,and commercial bribery clause is one of them.In the process of amending this law,the legislature has made major adjustments to the provisions of commercial bribery,and has redefined the standard of identification of commercial bribery based on the nature of commercial bribery.In order to make the new standard of commercial bribery be correctly understood and applied,this paper classifies the constituent elements of commercial bribery and interprets them one by one,helping market participants to clarify the context of the regulation of commercial bribery by the new law and better supervise their own behavior.
