On the basis of clarifying the legal relationship of Cruise Tourism Foundation,this paper discusses the compulsory liability insurance system which can effectively protect the rights and interests of passengers,including the compulsory insurance system of maritime passenger transport and the compulsory insurance system in tourism,so as to provide my own opinions and suggestions for establishing and perfecting the relevant regime.The main content of this paper is divided into four parts.The first chapter focuses on the basic legal relationship of contracts in cruise tourism,and,by comparing different viewpoints,tries to understand the formation of the basic legal relationship framework of cruise tourism on the basis of analyzing the reasons for the formation of the current complex legal relationship pattern.The second chapter mainly introduces the compulsory insurance system in the Protocol of the 2002 Athens Convention.The Maritime law(revised draft for comments),issued in November 2018,is clearly updated with the relevant elements of the Protocol to the 2002 Athens Convention,drawing on the compulsory insurance institution and other systems of marine passenger carriers,and therefore this chapter also makes an assessment of the relevant provisions of cruise ships.The third chapter focuses on the travel agency liability insurance,and compares the travel agency liability insurance with the compulsory insurance of the maritime passenger carrier and tourist accident insurance.Striving to form a complete understanding of travel agency liability insurance,as well as three kinds of insurance related to cruise tourism,two kinds of compulsory liability insurance overall understanding.The fourth chapter is the legal thinking on the compulsory liability insurance involved in cruise tourism.The main contents include: the relationship between compulsory liability insurance in cruise tourism;how to improve travel agency liability insurance and establish compulsory insurance for maritime passenger carriers,so as to better co-ordinate the two types of compulsory liability insurance in order to protect the rights and interests of cruise passengers and promote the development of cruise tourism;and some legislative proposals for these two types of compulsory liability insurance.
