Research On The Legal System Of Judge's Liability Immunity

China is undergoing a new round of judicial reform,but as more and more false and wrong cases are reported,the system of accountability of judges tends to be in a mainstream position,leading to our country judge to tremble in the work post.However,no country will restrict the exercise of judges ’rights through the accountability of judges.Based on his special status,Once a positive evaluation is made for one party,a negative evaluation is bound to be made for the other.Therefore,it is necessary to give certain guarantees to the judges.Although the false and wrong cases have occurred,there are different judicial situations in different eras.The rule of law in China is on the road to maturity.Based on China’s national conditions,the NPC deputies have stated in the proposal that they hope to establish a system of exemptions for judges.At 2016 years justice has been an inevitable topic of justice since ancient times to ensure that judges can independently conduct judicial trials and other judicial activities,and to avoid interference from external factors as well as to obtain fair judicial effects.The article combines the current judicial trial practice and discusses it from four parts:The first part is an overview of the judge’s jurisdictional exemption.This part mainly expresses about the origin of the judge’s liability exemption system and the regulations of the various countries on the exemption system for judges.And through the comparison to illustrate the reality,and then it expresses the status quo in China.The second part is mainly to analyze the necessity of establishing a system of exemption of judges’liability,as well as the reasons for the lack of establishment and the consequences of not establishing the system,and further highlights the necessity of establishing a system of judges’ liability exemption.The third part mains judge liability exemption system.On the one hand,this article bases on the theory of control and authorization,and finite understanding of rational theory.On the other hand,the relationship between the existing system of accountability in China is analyzed,and the ntwo parts are assisted to achieve the best results.The fourth part,through the above analysis,improves the judges’ liability exemption system in China based on the existing problems in our country and to determine the principle of the exemption of judges’ liability in our country,firstly determine that the principle of limited exemption of judges should be placed in the Judges Law,and also improve the selection system of judges in our country and the overall level of the judges.
