After the Song Dynasty,Chinese society emerged as a clan group with the common land(such as YiTian,JiTian,etc.),the ancestral hall,and the genealogy as the elements to restore the patriarchal system.Its manifestation is the compilation of genealogy according to the patriarchal system.The selection of the patriarch,the establishment of the Yitian,the revision of the ancestor and the family rules,in order to incorporate the same ethnic group into an organizational structure,the purpose is to maintain and strengthen the combination of clan to achieve social stability.Different from the early patriarchal system for the purpose of maintaining aristocratic separation,the patriarchal system after the Song Dynasty gained a deeper theoretical foundation through the combination of science and science.The socialization of science made the patriarchal concept widely spread.It is precisely because every aspect of society is influenced by the patriarchal concept that the patriarchal concept runs through the whole society,exists in all kinds of real things and organizational behaviors,and is accepted by the people.The traditional Chinese society after the Song Dynasty It can also be called a patriarchal society.The "great ritual controversy " in the Ming Dynasty was a political struggle caused by different patriarchal concepts.Due to the difference of patriarchal clan system,the two sides divided into " heir" and " successor".The two sides had a long-lasting argument about the honorific title and the main sacrifice of Emperor Jiajing(Zhu Hou Cong(1507-1567))and his father Xing Xian Wang Zhu You Yuan(1476-1519).Under the patriarchal society,the occurrence of " great ritual controversy" has certain inevitability,because the organizational form of the patriarchal society is a typical " household and state isomorphism ".The " household and state isomorphism" blurs the boundaries between " public" and " private" in traditional Chinese society,resulting in the country becoming the world of " one family and one surname".In the " family world" era,the emperor,as the master of the country,has the dual identity of " public" and " private".Any patriarchal affairs related to the royal family belong to the " great ritual" of the imperial court.The particularity of the emperor Jiajing's identity makes the " great ritual controversy " evolve from the debate on patriarchal ideology to political struggle.In the "great ritual controversy",the ceremonies arguing by both parties are a kind of political ritual applicable to royal rituals.This does not obscure the normative function of rituals on the lives of other members of society.At the level of social life,the etiquette norms at the national level are regarded as having natural legitimacy.The members of society use these etiquette norms to strengthen the legitimacy of the clan structure.The result of the "great ritual controversy" directly affects the clan construction after the Ming and Qing Dynasties..At the same time,as the core of the patriarchal system,ritual is the spiritual connotation of the patriarchal social control norms.The common role of the patriarchal social and political structure,economic structure and ideology structure has formed the control system of "the combination of ritual and law." In the patriarchal society,there are two parallel control norms—law and family law.First,the law is formulated by the state and suitable for the whole society.The content of the law must reflect the spiritual connotation of the ritual,so that the legitimacy can be obtained;Secondly,as a family law regulation that adjusts family relations or clan relations,it is also formulated according to the spiritual connotation of rituals.The integration of ritual and law constitutes the basic characteristics of patriarchal social control norms.The outbreak of the "great ritual ceremony" is a concentrated reflection of the patriarchal society's autocratic imperial power,the landlord's small-scale peasant economy,and the ideology's rigid.The changes in the patriarchal social structure allow the original norms to no longer exert control functions,and the patriarchal system loses its social foundation.The transformation of China's modern society urgently needs to build a new system of control norms.The rule of law,as a paradigm of modern social control,is the result of the transformation of modern China's political structure,economic structure,and ideological structure.Taking the law as the core of the modern social control system does not deny the social control functions of other mechanisms or norms.Whether in modern society or traditional society,family as the starting point of social organization relationship,good family relationship and family education are conducive to the shaping of individual sociality.In the "great ritual ceremony",both parties recognize the family under the patriarchal system.The social control function,and the purpose of the clan organization construction,this shows that the establishment of family relations and family education can be regarded as a supplementary mechanism outside the legal control.
