On The Service System Of Civil Announcements

Civil service throughout the proceedings is an important means of transmitting the litigation information of the Court,the parties and other litigants.It is not only the procedural guarantee of the parties ' litigation rights,but also help the Court trial run effectively.Among them,the issue of announcement service has always been a constraint on the work of the Court,the reason is that the service has been on the edge of the work of the Court.In the judicial practice it has not been paid enough attention,resulting in rough random delivery,so that the purpose of the notice service can not be achieved,the effect of the announcement service is greatly reduced.The era of science and technology has led to the development of related industries,but also promoted the change of court service mode,but China's legislation on the service system provisions are still conservative.In judicial practice,the conflict between the new problems and the backwardness of laws and regulations is urgent to be solved,and there are many theories and viewpoints in the academic circles,but they still do not form a feasible system to improve the way.Combining with the practical problems in judicial practice,this paper further combs the problems in the actual operation of the announcement through the methods of literature research,theoretical comparison and practical investigation.The delivery of more work,high delivery costs and large population mobility problems constantly challenge the traditional announcement delivery model;The court "on one shoulder" service state,the party conceals,lies about,avoids the lawsuit and so on dishonest behavior becomes "the difficult service " inducement.Based on the analysis of legislation,judicature,society and economy,this paper tries to find a scientific and effective way to solve the practical problems in China by comparing the service system of announcement abroad with the current situation of service of announcement in China.In addition,the paper puts forward feasible suggestions from the aspects of improving the service by announcement,perfecting the original service method and innovating the new service method.
