For China,which is in the stage of rapid development,there have been many legal problems that need to be solved in the judiciary in recent years.One of them is that the growth rate of the number of caseworkers does not match the growth rate of the cases.In order to maximize the rational allocation of judicial resources,reduce the pressure of handling cases,truly realize the simple diversion of cases,constantly improve the efficiency of litigation justice,plea guilty and punishment from the operation of lenient system.In essence,the emergence of this system is an inevitable requirement for judicial reform.It is composed of a series of specific legal systems and the degree of litigation.It is also in line with the current value and value orientation of the times.In recent years,the pilot situation shows that although remarkable results have been achieved,there are still many shortcomings.Through in-depth study of the plea of guilt and punishment system combined with practical cases,we can find out the unreasonableness in both theoretical and practical levels,and find out the problems of the primary election in judicial practice,which will play a very positive role in the progress of judicial reform and the continuous improvement of the litigation system in our country.
