Research On Securities Group Litigation From The Perspective Of Investor Protection

2018 is the 40 th anniversary of China's economic system reform,China has become the world's second largest economy after the United States.The rapid development of the economy will inevitably lead to rapid progress in the securities market,but it has to be seen that behind the prosperous securities market,there are still hidden problems such as false statements,insider trading,manipulation of the market,fraudulent customers,etc.The frequent occurrence of such securities infringements has hurt investors' confidence,and it is difficult for injured investors to obtain effective judicial relief through litigation,which seriously affects the healthy development of the securities market.Based on the current judicial cases and data analysis,the paper believes that the status quo of China's securities investor protection is not optimistic,and the current securities infringement litigation system has various defects.Facing the shortcomings and combining with the practical problems of investor protection in our country,we can learn from and learn more advanced securities group litigation system from the perspective of investor protection.The article takes the American group litigation system as a reference,comprehensively considers the advantages and disadvantages of the system,and conducts a feasibility analysis of the system transplant,and proposes to add a securities group litigation opt-out system,appropriately retain the litigation pre-procedure,expansion of case acceptance scope,improvement of litigation representative selection system and establishment of litigation support system for securities group litigation,etc.,in order to construct a securities group litigation system in line with China's national conditions.In the end,it is expected that after the investor is subject to securities infringement,the investor's rights can be fully judicially and judicially guaranteed through an effective litigation system.
