Research On Sentencing Issues Of Corruption And Acceptance Of Bribes

The sentencing standard of corruption and bribery crimes is an important legal basis for the punishment of corruption and bribery crimes,which is of great significance for the smooth progress of China's anti-corruption work and the achievements to be achieved.In order to better serve the punishment of corruption and bribery crimes,Criminal law amendment(9)and about to deal with corruption and bribery criminal cases to explain some issues of applicable law(hereinafter referred to as "explain")in 1997 made great adjustment,corruption and bribery crime sentencing standards make embezzlement and bribery crime punishment system more perfect,able to solve the problem of sentencing imbalance and improve the efficiency of corruption crime case,but there are still some problems after the change: bribery sentencing standards completely attached to the amount of corruption + plot Binary sentencing standards and special light system there exist certain defects,etc.,This paper believes that it is necessary to actively learn from the successful experience of foreign countries on the sentencing standards of corruption and bribery crimes,strengthen the system construction of judicial organs,separate the sentencing standards of bribery crime and corruption crime,gradually abolish the death penalty provisions,and introduce the legislative model of crime group.
