Research On The Crime Of Extortion

In our country,as a kind of crime of violating property,the crime of racketeering happens more frequently.Because our country's criminal law adopts the legislation mode of simple crime to stipulate the crime of extortion,which brings some difficulties to the theoretical research and judicial practice.In judicial practice,we often encounter cases where the criminal constitution of the crime of extortion is not clear enough to dispute the characterization of the behavior of the perpetrators.For the better to protect the legitimate rights and interests of citizens,we must safeguard legal authority and fairness and justice.Accurate definition and appropriate penalties are necessary.this paper expounds the boundaries between extortion and civil over-protection of rights,the nature of extortion caused by emotional entanglement,and the boundaries between extortion and robbery.This article aims at discussing the disputes and the indefinable places in the identification of extortion through the case analysis in judicial practice,and differentiating the distinction between extortion and other crimes,so as to provide reference for the determination of extortion in judicial practice.
