Research On Compensation Responsibility For Experimental Injury Accidents Of College Students

Since the expansion of college enrollment in 1999,along with the economic and social changes and the development of the information age,higher education has also undergone profound changes.In recent years,in the process of reform and development of higher education,college students' education has realized the transformation from elite education to popular education,including enrollment scale,student level,management mode,logistics socialization,information technology,credit system,etc.Many changes,such as the transformation of employment and career selection,bring opportunities to higher education and inevitably bring great challenges.The disputes and cases between college students and universities occur frequently,which exposes the insufficiency of university management to a certain extent.The experimental injury accident of college students is a typical one.This paper takes the experimental injury accident of college students as the core theme and research content,and attempts to provide a kind of inspiration or reference for the handling of the injury accident of college students.The risk of accidents is unpredictable because of the danger and complexity of college students' experiments.The research in this paper is helpful to promote legislation,to promote justice,to strengthen laboratory construction and management in colleges and universities,to improve safety awareness and responsibility consciousness,and to provide reference and inspiration for dealing with injury accidents of college students.From the point of view of domestic research,the research on experimental injury accidents of college students is rare,and there is no systematic research on the thesis of master's degree,the research angle is different,scattered and unsystematic.Abroad,Japan,the United States,Germany and other countries have special laws or laws on campus accidents.Besides the introduction and conclusion,the paper contains four chapters.The first chapter summarizes the basic concepts,meanings,characteristics,causes,nature of responsibility,legislative status,existing problems and typical cases of college students' experimental injury accidents.The second chapter analyzes and proves the experimental injury accident of college students from the principle of imputation and compensation.The third chapter mainly expounds analysis of accident liability,liability for compensation and the subject of liability of college students' experimental injury accident.The fourth chapter,mainly from perfecting the relevant laws and regulations,setting up the college liability insurance,perfecting the student accident injury insurance,perfecting the safety management system,strengthening the safety education work,elaborated in detail the solution countermeasure of the university student experiment injury accident.In the course of this study,literature analysis method,historical analysis method and case analysis method are adopted.The innovation of this paper lies in its novelty and reality,its systematicness and its characteristic of case.In the new era,in the course of studying and implementing Xi Jinping's socialist thought with Chinese characteristics and the spirit of the 19 th National Congress of the Party,and in the process of comprehensively promoting the rule of law and administering schools according to law,we will certainly take this opportunity to attach equal importance to both theory and practice.This paper actively studies the legislation and judicial problems of college students' experimental injury accident,actively prevents and solves the similar college students' experimental injury accident,as far as possible,maintains the rights and interests of teachers and students,maintains the order of teaching and scientific research in colleges and universities,and promotes the harmony and stability of the society.
