Analysis Of The Crime Of Fund-raising Fraud

With the continuous development of the market economy,various forms of economic activities emerge in an endless stream.The phenomenon of illegal fund-raising in China is increasingly serious,and the crime of fund-raising fraud is also on the rise.This article around the formation of the crime of fund-raising fraud,the difference with other charges and judicial practice issues to start.Focusing on the theoretical dispute of fund-raising fraud,combined with practical cases,to conduct a comprehensive study,in order to clarify the theoretical meaning of fund-raising fraud and the correct application.The first part of this paper starts from the qualitative analysis of the purpose of illegal possession,combines the theoretical dispute with judicial practice,and makes an in-depth analysis of the meaning of the purpose of illegal possession in this crime.Then around the fund-raising fraud behavior and the meaning of public to discuss,clear their respective theoretical meaning.Secondly,it discusses the distinction between the unit crime and the crime of natural person in the crime of fund-raising fraud,and makes it clear that the case of fund-raising fraud should belong to the crime of natural person,as well as the conviction and punishment of different actors in the joint crime.Thirdly,for the crime of illegally absorbing public deposits,this paper divides it from the perspective of theoretical composition and objective practice,so as to better distinguish this crime from that crime in judicial practice.Finally,from the practical perspective of handling fund-raising fraud cases,the author discusses the problems that may exist at present,and puts forward corresponding solutions,so as to better play the role of fund-raising fraud in combating criminal activities.
