A Qualitative Study On Fraudulent Use Of Other People's Alipay To Transfer Funds

With the continuous development of communication and network programming technology,the third-party payment method represented by alipay has become increasingly popular in life.While the alipay platform has brought great convenience to people's life,the illegal acquisition of others' property through the third-party payment has gradually come into people's eyes.As a new thing,third-party payment is different from previous credit card crimes,and its nature and legal positioning are still blank.Theoretical circle for the use of others to transfer the qualitative behavior of alipay also exists greater differences.Based on the real cases in practice,this paper first introduces the different viewpoints of various scholars by describing specific cases,and then summarizes the corresponding academic disputes.Secondly,it analyzes the theoretical disputes,such as the nature of alipay,the relationship between alipay and users,and the relationship between alipay and bank card payment.Finally,by comparing the existing views and analyzing the crime composition of credit card fraud,fraud and theft,the nature of transferring money using others' alipay is finally determined.
