Exploring The Ownership Of Frozen Embryos

Frozen embryo technology is a part of human assisted reproductive technique,which is the maturest mesns of fertility.With the exnertal fertilization including embryo transplantation and embryo freezing technique using widely and developing rapidly,The life value and ethic issues involved in it are gradually exposed and increased.The dispute resolution can't do without regulation of law.but at the moment,our country doesn't have legislative protection which aims at frozen embryo.There is also no clear definition in legal nature and status of frozen embryo.The problem of frozen embryo' sright attribution is also divided.This article takes typical cases of frozen embryo as pointcut,which explores the legal nature and status of frozen embryo and defines frozen embryo as“ Personality content”.Secondly,on the basis of defining frozen embryo as “Personality content”,there is classifying frozen embryo and stating all kinds of ownership which is following attribution principles.Finally,on the basis of referencing foreign law and looking at China's national situation and relational morality,this article offers some suggestions about law,in order to develop human assisted reproductive technique more and more mature,filling in gaps of our low.While advanced technology benefits human,it must accord with demand of laws and ethic.
