Research On Criminal Electronic Data Review And Judgment

The Criminal Procedure Law,which was revised in 2012,stipulates that the electronic data of the era and the technical nature shall be stipulated in the form of legislation as the statutory type of evidence.In September 2016,the issue of collecting and extracting criminal documents and reviewing and judging electronic data The Regulations not only stipulate the methods and methods for investigators to obtain electronic data,but also regulate the examination and judgment of electronic data from the perspective of evidence ability and proof.Although the electronic data regulations have a huge impact on the development of criminal electronic data in China,it is undeniable that there are still some problems in the regulation of criminal electronic data in China.In view of this,this paper starts from the definition of electronic data and the characteristics of electronic data,introduces the principles of reviewing and judging criminal electronic data,and draws on the successful experience of foreign electronic data review and judgment,combined with the new introduction of China.The shortcomings in the electronic data regulations finally put forward suggestions on the review and judgment of criminal electronic data in China,and hope that this article can have a positive impact on the development of China's criminal electronic data system.
